For example, hearing a case in the absence of the Claimant where the claimant bears the burden of proof, is very likely to mean that the Tribunal would be simply going through the motions of hearing the Respondent’s evidence when it is very unlikely the Claimant will meet the burden of proof because they have no sworn or tested statement and the Tribunal can only attach slender weight to it. 98.
