Here, the House of Lords emphasised that discrimination claims are often fact-sensitive and require close examination of the evidence at a full merits hearing. 9. Further caution has been advised in Bahad v HSBC Bank plc [2022] EAT 83 against striking out claims before a full merits hearing.
